Magnitude 6.6 earthquake strikes near Palu in Indonesia: USGS

JAKARTA (Reuters) - A magnitude 6.6 earthquake struck 35 miles southeast of Palu on the Indonesian island of Sulawesi on Saturday rattling crockery as people were breaking the Ramadan fast but there were no immediate reports of casualties or damage, authorities said.

The quake was originally reported by the USGS as a magnitude of 6.5. The depth was reported at 12.5 miles.

"The quake was felt strongly for 15 seconds in Palu as people were breaking the fast," said Sutopo Purwo Nugroho, spokesman for Indonesia's National Disaster Mitigation Agency.

The quake has no tsunami potential and no damage is reported, said Subagiyo, an earthquake center official in the capital Jakarta.

The U.S. Pacific Tsunami Warning Center said a destructive tsunami was not generated by the earthquake and that the Japan Meteorological Agency may issue additional information on the quake.

The NFL?s new regular season opens on September 5 in New York.? The next day the league and the NFLPA will be fighting over an old wound in Minnesota.

In advance of the September 6 hearing regarding the union?s effort to reopen the settlement agreement that ended the 2011 lockout and the litigation that went along with it, the NFL has filed a brief opposing the notion that the league had a ?secret salary cap? in the supposedly uncapped year of 2010.

The 22-page document, a copy of which PFT has obtained, makes the point that we made when the NFLPA filed the collusion claim earlier this year:? The players are trying to advance legal theories that the players expressly and affirmatively waived when the lockout ended.

The NFL focuses primarily on the settlement of a pair of antitrust lawsuits (one filed by Reggie White and other in the 1990s and one by Tom Brady, Drew Brees, and others in 2011) as the ?end of one historic era . . . and the beginning of another.?? The league also argues that the players ?agreed ? not once, but twice ? to put an end to all claims of any kind? arising under the lawsuits that were pending at the time the collusion allegedly occurred.

The league further explains that, even if the claims hadn?t been waived, the NFLPA waited too long to assert them, pointing to the deadline for filing the claims ? 90 days after the NFLPA ?should reasonably have discovered? the violation.? The league believes that the NFLPA should have known enough in 2010 to assert that collusion was occurring.? (Of course, if the NFLPA had done so at the time, the NFL would have called the claim frivolous, or worse.)

As we?ve explained in the past, the settlement of any lawsuit usually includes a broad waiver of any claims that were made or that could have been made.? The parties are resolving all of their differences and moving forward with a clean slate.? Here, a claim that the NFL wasn?t treating the uncapped year as an uncapped year could have been made, and arguably should have been made, in 2010.? By striking a comprehensive settlement agreement in 2011, the claim for collusion that allegedly happened in 2010 necessarily was forever waived.

Of course, that result hinges now on Judge David Doty agreeing that the paperwork contains the right language to slam shut the door to his courtroom.? If Judge Doty finds that the NFL?s lawyers ultimately failed to concoct a big-word salad that properly waived the collusion claim (and if the ruling survives the appeal process), the NFL?s lawyers who were responsible for this won?t be the NFL?s lawyers for very much longer.

All that said, the NFL still has a problem.? Like Judge Berrigan in the bounty cases, who has publicly criticized the fairness (or lack thereof) of the league?s discipline process against players like Saints linebacker Jonathan Vilma, Judge David Doty could say at the hearing, ?The NFL engaged in collusion in 2010, and if there?s any way I can legally hold them liable, I will.?

The arguments made by the NFL in its written submission should prevent a bad outcome.? But it won?t prevent the bad P.R. that would come from a public declaration by a federal judge that the NFL (as it appears, and as we?ve reported) told the teams not to take full advantage of the uncapped nature of the uncapped year.? Even if the NFL manages to avoid liability for collusion, all sorts of bad things can happen when a federal judge concludes that a billion-dollar business has engaged in illegal labor practices of a fairly significant nature, especially in light of the fact that there are always a handful of folks in Congress who would be inclined to call a hearing on a high-profile topic like this.

Even though the NFLPA claims the players didn?t realize collusion had occurred until after the Cowboys and Redskins challenged the decision to strip salary cap space from the two teams in 2012 due to their failure to abide by the unwritten cap rules in 2010, the NFLPA at least should have known in 2010 that collusion possibly was happening ? and the NFLPA definitely should have known when asked to sign off on the cap penalties that something was fishy.

Instead, the NFLPA gladly agreed to the cap penalties, because the NFLPA at that time desperately needed the NFL to agree to tinker with the salary cap in order to ensure that the team-by-team spending limit would climb, not drop, from 2011 to 2012.? (That fact alone should may any judge, no matter how potentially biased or partial, find in favor of the NFL.)

No matter how this one turns out, someone is going to look bad.? The NFL?s lawyers will look bad for not properly sealing off the players? ability to claim collusion after the fact, or the NFLPA?s lawyers will look bad for not filing a collusion claim in 2010 ? and for agreeing to the cap penalties in 2012, if Judge Doty points that out in a way that prompts enough players to ask the NFLPA tough, direct questions about that strategy and the underlying reasons for it.

Either way, Judge Doty likely will be generating sound bites that will reflect poorly on the NFL regarding the issue of collusion in the uncapped year ? and that will set the stage for even more acrimony the next time the CBA moves closer to its expiration date.

UN to consider new Syria office after observers go

UNITED NATIONS (AP) ? The Security Council on Thursday will debate whether to establish a new civilian office to support U.N. and Arab League efforts to end the 18-month conflict in Syria as the U.N. military observer mission comes to an end Sunday.

The council had set two conditions for possibly extending the mission of the unarmed observers past Aug. 19: a halt to the government's use of heavy weapons and a significant reduction in violence. In a letter to the council last Friday, U.N. Secretary-General Ban Ki-moon said neither condition was met and Syria now risks "a descent into a full-scale civil war."

But with the end of the unarmed observer mission looming, Ban said, "it is imperative for the United Nations to have a presence in Syria" aside from its humanitarian operation in order to support U.N. and Arab League efforts "in mediating and facilitating a peaceful resolution to the crisis."

"I intend therefore to work in the immediate future towards establishing an effective and flexible United Nations presence in Syria that will support our efforts with the parties to end hostilities," Ban said.

France's U.N. Ambassador Gerard Araud, the current Security Council president, said members will be discussing the observer mission and Ban's proposal at a closed meeting on Thursday where they will be briefed by Assistant Secretary-General for Peacekeeping Edmond Mulet.

"I think there is a consensus among the members of the Security Council that we need to have a U.N. presence remaining in Damascus, in Syria, after Aug. 20," Araud told reporters on Wednesday. "We'll see whether it's possible to have a consensus around the proposal of the secretary-general."

The Security Council initially authorized the 300-strong observer mission to deploy to Syria for 90 days to monitor implementation of a six-point peace plan brokered by U.N.-Arab League envoy Kofi Annan. The plan was to start with a cease-fire and withdrawal of the government's heavy weapons and culminate with Syrian-led political talks.

President Bashar Assad's government and opposition forces agreed to the plan, but it was never implemented.

Because of the worsening bloodshed and insecurity, the observers have been mainly confined to their hotels since June 15 and their numbers have been cut by about two-thirds.

The U.N. said Wednesday that 110 observers remain in Syria, mainly in Damascus. A bomb exploded Wednesday outside their hotel, wounding three people, but no observers were hurt.

Frustrated at the escalating conflict and the failure of world powers on the Security Council to unite to stop the chaos, Annan announced last month that he was resigning effective Aug. 31.

Ban told reporters in East Timor on Wednesday that he is expediting the selection of a successor to Annan, and he again urged government and opposition forces to stop the violence and start a political dialogue.

"More than 18,000 people have been killed during the last 18 months," Ban said. "The Syrian people have suffered too much too long. The international community must feel the sense of collective responsibility on this situation. How long do we have to endure this kind of a tragedy? This is not justice and this is not acceptable."

On Tuesday, a spokesman for Annan said Syrian authorities have backed former Algerian Foreign Minister Lakhdar Brahimi, a veteran U.N. troubleshooter in hotspots including Afghanistan and Iraq, as his successor, but it was unclear whether Brahimi had accepted the post.

Several U.N. diplomats, speaking on condition of anonymity because no announcement has been made, said Brahimi wants a signal of support from the deeply divided Security Council. Russia and China have vetoed three Western-backed Security Council resolutions that would have stepped up pressure especially against the Syrian government by threatening sanctions if the fighting didn't stop.

France's Araud said he had no information about Brahimi but told reporters that any candidate to replace Annan has to take into account the council divisions and the situation on the ground. At the moment, both sides believe they can win militarily and there is no prospect of a political transition, he said.

"It's a bit (of an) impossible mission. So I do understand that people hesitate to take this mission, but ... we need to have somebody who could be available if there is any prospect of launching a political process," Araud said. "The U.N. simply can't leave the room."

Intel, Apple praised for clean mineral efforts

DAKAR, Senegal (AP) ? Apple, Hewlett-Packard and Intel have become "pioneers of progress" through their efforts to avoid purchasing minerals that fund armed groups in Central Africa, an advocacy group said Thursday.

The Enough Project ranked companies based on the steps they have taken to make sure their mobile phones, iPads and other gadgets aren't paying for the weapons used to terrorize Congolese civilians.

The group's advocacy was instrumental in pushing through U.S. legislation that has caused a dramatic decline in the minerals trade from embattled areas of the Congo. However, the reduction in exports hasn't led to a corresponding decrease in violence ? eastern Congo is in the grip of a fresh rebellion, and 280,000 people have fled their homes since April.

Congo is home to about 70 percent of the world's supply of tantalum, a metal used in cellphones, according to the U.S. Geological Survey. The vast country also has massive amounts of tin, gold, copper and cobalt.

Although most of the companies had shown improvement since 2010, the Enough Project cited video game console maker Nintendo Co. as trailing behind the rest of the industry when it comes to "conflict minerals."

Armed groups vying for control of these riches have used profits from illegal mining to purchase weapons used in gruesome attacks on civilians. In other cases, they have captured people and forced them to do the digging.

"The exploitation of Congo's mineral resources continues to exacerbate conflict and instability on the ground and consumers are still largely in the dark as to whether or not their products are conflict free," the report said.

The idea that mining exacerbates the Congolese conflict is controversial. Many experts say the real problem in eastern Congo is the lack of a functioning government, not that there are valuable minerals there.

"The minerals trade is a symptom of a deeper problem ? that nobody is in charge," said Laura Seay, an assistant professor at Morehouse College in Atlanta who studies the eastern Congo and travels there.

Thursday's report comes just days before a key development is expected on the issue. U.S. legislation passed in July 2010 required American companies using tungsten, tin, tantalum and gold to reveal their supply chains in an effort to avoid using conflict minerals.

However, the law has not been fully implemented yet because the U.S. Securities and Exchange Commission has yet to draft rules on how the law should be applied. The SEC is due to vote on those final regulations next Wednesday.

Even though that law is not yet in effect, the Enough Project said its existence already had helped propel many companies to take action.

The Washington-based group praised Intel Corp. for its pledge to produce a conflict-free microprocessing chip by 2013, becoming the first company to publicly commit to such a deadline.

It also singled out Hewlett-Packard Co. as "the most active corporate participant in a diplomacy work group on Congo."

Apple Inc. was the first company to require its suppliers to use only metals from smelters that have been certified "conflict-free," when enough are available, the Enough Project said.

The group also gave high points to Motorola Solutions Inc., Royal Philips Electronics N.V., Acer Group, Dell Inc. and Microsoft Corp., but described other companies as "laggards."

"Despite growing public awareness about this issue and significant industry movement, Nintendo has made no known effort to trace or audit its supply chain," the report said. "Sharp, HTC, Nikon, and Canon are taking initial steps to join industry efforts, but their progress remains far behind industry leaders."

In a statement released Thursday, Nintendo said it outsources the manufacture and assembly of all Nintendo products and "therefore is not directly involved in the sourcing of raw materials that are ultimately used in our products."

"We nonetheless take our social responsibilities as a global company very seriously and expect our production partners to do the same," the statement said.

The Enough Project said that it wanted the companies to know more about the origins of the minerals they were buying, but not to avoid buying from the country altogether.

"A handful of companies are helping Congo develop a clean trade, but some companies are taking a hands-off approach to instruct their suppliers to not buy minerals from Congo and the region," the group said. "This approach helps cut off armed groups but leaves mining communities in Congo behind."
